These Terms of Service (“Terms”) govern your use of the GME ACTION website, services, accounts, and related communications, and your enrollment in a GME ACTION membership. These Terms are published by Optik Consulting Strategies LLC and Mission Insurance Partners, Inc., the businesses that own and operate the GME ACTION brand, located at 9901 Brodie Ln, Suite 160-751, Austin, TX 78748. Emergency medical-transport services are powered by Global Medevac. By accessing or using GME ACTION, you agree to these Terms.
GME ACTION is a medical transport membership program and is not insurance. Membership benefits, eligibility, geographic availability, transportation authorization, exclusions, limitations, and member financial responsibility are governed exclusively by the applicable membership agreement. Emergency medical transportation and assistance services are powered by Global Medevac. GME ACTION does not replace health insurance, travel insurance, or emergency medical services. GME ACTION is the brand and trade name used by Optik Consulting Strategies LLC and Mission Insurance Partners, Inc. These Terms of Service and this Privacy Policy belong to, and are published by, those businesses for the GME ACTION program.
2.Acceptance of these GME ACTION Terms
By accessing the GME ACTION website, creating a GME ACTION account, or enrolling, you accept these Terms and the GME ACTION Privacy Policy. If you do not agree, do not use GME ACTION.
3.Eligibility
You must be at least 18 years old and able to form a binding contract to enroll with GME ACTION. Coverage for minors, if offered, must be arranged by a parent or legal guardian under a Family plan.
4.Description of the GME ACTION membership
The GME ACTION Membership is not insurance. It is a membership program under which covered emergency medical-transport costs are handled per the terms of your membership agreement. Benefits, coverage, and eligibility are governed by the GME ACTION Membership Agreement, which controls in the event of any conflict with marketing content on the site.
5.Accounts and account responsibilities
You are responsible for the accuracy of the information you provide to GME ACTION and for maintaining the confidentiality of your account credentials. Notify GME ACTION promptly of any unauthorized use of your account.
6.SMS messaging and two-factor authentication
GME ACTION may send transactional SMS messages to users who voluntarily provide their mobile telephone number and request authentication or account-security services.
SMS messages may include one-time passcodes (OTPs), verification codes, login authentication codes, password-reset codes, and other account-security communications.
GME ACTION does not use this SMS program to send marketing or promotional messages.
Message frequency varies based on user-initiated authentication activity. Message and data rates may apply.
Users may reply STOP to opt out of applicable SMS communications and HELP for assistance.
Consent to receive SMS messages is not a condition of purchasing any goods or services from GME ACTION.

7.Fees, billing, and auto-renewal
GME ACTION membership fees are shown at enrollment. A 1-year membership (Individual or Family) is a 12-month commitment paid either in full up front or in 12 monthly installments — installment billing is a payment method, not a month-to-month membership. A 5-year membership covers five full years at today's locked-in rate and is paid either in full up front or in 12 equal monthly installments; on the installment option, payments end after month 12 while the membership continues for the full five-year term.
Memberships bill in advance and automatically renew at the end of their term (every 12 months, or every five years) at the then-current rate until cancelled. By enrolling you authorize GME ACTION or its payment processor to charge your payment method for the applicable fees, installments, and renewals. The amount charged today, the total contractual price, the payment schedule, and the renewal date are shown to you before you complete checkout.
8.Cancellation and refunds
You may cancel at any time as described in the GME ACTION Refund & Cancellation Policy, which is incorporated by reference. In summary: new paid-in-full memberships (12-month or five-year) may be refunded in full within 14 days of purchase if no covered transport benefit has been used. Memberships paid in monthly installments may be cancelled within the same 14-day window for a full refund of amounts paid; after that window the remaining installments of the 12-month term are due and are non-refundable.
9.Acceptable use
You agree not to misuse the GME ACTION website, submit false information, infringe others' rights, or attempt to disrupt or gain unauthorized access to GME ACTION systems.
10.Intellectual property
The GME ACTION brand, marks, content, and website are owned by GME ACTION or its licensors and are protected by law. GME ACTION grants you a limited, revocable license to use the site for its intended purpose; no other rights are granted.
11.Third-party fulfillment
Program services are provided by Global Medevac and its provider network. GME ACTION is not the medical-transport provider and does not deliver emergency services directly; provider performance is subject to the Membership Agreement and applicable law.
12.Disclaimers
The GME ACTION website is provided “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law. GME ACTION does not warrant that the site will be uninterrupted or error-free.
13.Limitation of liability
To the fullest extent permitted by law, GME ACTION is not liable for indirect, incidental, special, or consequential damages arising from your use of the site, and GME ACTION's total liability relating to the site shall not exceed the fees you paid in the twelve (12) months before the claim. Benefits and any liability relating to covered services are governed by the Membership Agreement.
14.Indemnification
You agree to indemnify GME ACTION against claims arising from your breach of these Terms or misuse of the site.
15.Termination
GME ACTION may suspend or terminate your account or access to the site at any time for breach of these Terms, suspected fraud, or as required by law. You may stop using the site and cancel your membership at any time as described above. Provisions that by their nature should survive termination will survive.
16.Governing law and dispute resolution
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Disputes shall be resolved in the state or federal courts located in Travis County, Texas, and you and GME ACTION consent to that jurisdiction and venue.
17.Changes to these terms
GME ACTION may update these Terms; material changes will be posted with a new “last updated” date on this page. Continued use after changes constitutes acceptance.
